These terms apply to container rentals supplied by Utica Dumpster Rental Group. Booking a container means accepting them.

Quotes and pricing

Quotes are given as a flat rate covering delivery, the stated rental period, collection, disposal and a stated tonnage allowance. Loads exceeding the tonnage allowance are charged at the per-ton overage rate quoted at booking, evidenced by the disposal facility scale ticket, which is available on request.

Rental period

The standard rental period is stated at booking. Extensions are charged at the daily rate agreed at booking. Please give notice before the scheduled collection date if a project is running long.

Placement, permits and debris responsibility

A container placed on private property such as a driveway is placed to meet the City of Utica's rules. Where a container must be placed in the street or public right-of-way, this is arranged with the City of Utica first; the customer is responsible for providing accurate placement information. In Oneida County, the Oneida County Recycling Center accepts household recyclables, brush, tires and oil but does not accept construction or demolition debris, which must be taken to the transfer station or the Oneida-Herkimer Solid Waste Authority; under New York's open-burning ban open-burning rules, the open burning of construction, demolition, remodeling and commercial waste is prohibited, and pressure-treated lumber may not be burned. The customer remains responsible for compliance with all applicable City, County and State requirements at the job site.

Disposal and prohibited materials

Debris is transported to the transfer station or the Oneida-Herkimer Solid Waste Authority or another licensed facility. Clean concrete, brick and asphalt may be recycled or reused as fill and clean scrap metal is recycled; brush, yard waste, tires and oil are routed to the Oneida County recycling centers; electronics and household hazardous waste are routed to the Oneida County collection; and appliances containing refrigerant (Freon) require the refrigerant to be professionally recovered first. The customer is responsible for the contents of the container. The following must not be placed in a container: household hazardous waste including paints, solvents, oils, fuels, antifreeze, pool chemicals and other chemicals; whole tires; lead-acid and lithium batteries and used motor oil; electronic waste; appliances containing refrigerant unless the refrigerant has been professionally recovered and certified; other liquids; propane and other pressurised cylinders; medical or biohazardous waste; and any material classified as hazardous. Barred and prohibited materials route to an approved recycler, a retailer, the Oneida County recycling centers, the annual Oneida County household hazardous waste collection event or another appropriate facility rather than being placed in a general container. Concrete, block and clean masonry must be placed in a designated clean-load container, and soil and stone must be kept clean and as dry as practicable to avoid excess weight charges. The customer is responsible for any charges, fines or remediation costs arising from prohibited or barred material.

Access and property

The customer is responsible for ensuring a safe, legal and accessible placement location. We protect surfaces with planking as standard, but cannot accept liability for damage to driveways, curbs, sidewalks, lawns, soft or wet ground, underground services, septic systems, wells, irrigation or paving arising from a placement requested by the customer.

We may decline a placement where we judge it unsafe or likely to cause damage, including on soft, wet or thawing ground that will not carry a loaded container, and will discuss alternatives.

Loading

Containers must be loaded level with the rim. Loads heaped above the rim cannot be legally transported and will need to be reduced before collection. Every load is covered and secured before transport as required under New York law; the customer must not remove or defeat that covering.

Collection

Access must be clear on the scheduled collection date. Where a container cannot be collected because access is obstructed, a failed collection charge applies.

Liability

Our liability in connection with any rental is limited to the amount paid for that rental. We are not liable for indirect or consequential loss, including project delay.

Payment

Residential rentals are payable at booking. Account customers are invoiced on agreed terms. Overage and additional charges are invoiced after collection with supporting documentation.

Governing law

These terms are governed by the laws of the State of New York.
